This is the process in which an individual files a new divorce case. The Magistrate or Judge overseeing the case issues an Order for Mediation/Alternative Dispute Resolution, at which point the parties must contact a mediator to schedule a mediation session. Whether your case is contested or non-contested, with children or without, the mediator can help facilitate an agreement between both parties to include any and all pending issues. If the parties are able to settle their case, the mediator drafts a Separation Agreement (and Parenting Plan for divorces with children) for the parties to review, sign, and submit to the Court.
This is the process in which an individual files a new case with the Court requesting a Parenting Time and Child Support Order. The Court opens a new case called Allocation of Parental Responsibilities. The Magistrate or Judge overseeing the case refers the new case to mediation. The mediator then helps to facilitate an agreement between the parties to include any and all pending issues related to parenting time and child support.
This is the process in which an individual requests the Court to change a previous Parenting Time and/or Child Support Order. The parties are sometimes referred to mediation. In this case, the mediator can help facilitate an agreement between the parties to include a new parenting plan. The mediator can also help the parties calculate their financial information for a new Child Support worksheet.
